1. Applicability
1.1. These general terms and conditions apply to all offers and agreements relating to the performance of assignments by the Contractor for the Client.
2. Sign up
2.1. The registration for an assignment is completed by registering and making payment via the Equinestudies webshop. After registration, you have a 14-day cooling-off period.
2.2. After registration and online payment, you will receive an (electronic) confirmation of receipt, which makes your registration final.
2.3. You will also immediately receive a digital invoice for the assignment(s) you have selected.
If the registration concerns the mastery program, you will receive an invoice later by email, depending on the payment term you have chosen. This invoice must be paid within two weeks.
2.4. All assignments are held subject to sufficient enrollment.
2.5. The Contractor reserves the right to change the location at the Contractor’s discretion.
2.6. Registrations are processed in the order in which they are received.
2.7. By registering, you agree to the general terms and conditions.
3. Cancellation and changes
3.1. Cancellation of the assignment must be made in writing (by e-mail). For the purpose of assessing the cancellation period, the date your e-mail is sent will be used. Your cancellation is only final after receipt of a confirmation.
3.2 You can cancel your registration up to 6 weeks before the start of the assignment and will receive 80% of the total training fee or deposit back.
3.3. No refund of your deposit or training fees will be given for cancellations received within 6 weeks of the start of the assignment.
3.4. If you have another participant take your place, no additional administrative fees will be charged. You must inform the Contractor in writing in advance.
3.5. In case of non-attendance by the participant, the full training fees are due.
3.6. The Contractor reserves the right to make organizational or content-related changes to an assignment.
3.7. If the assignment is cancelled due to insufficient participation or unforeseen circumstances, you will receive a full refund of the course fee or deposit within 30 days.
3.8. In the event of mid-term withdrawal from the assignment, financial obligations remain in effect. You may later rejoin the same training or course free of charge under the then-applicable conditions. Financial changes may have occurred that could be to your disadvantage. Discounts and similar offers do not apply to students who re-enroll.
4. Payment
4.1. The Client must make payment for an assignment immediately via the webshop, and if payment is not made through the webshop, it must be completed within 14 days at the latest. The rates can be found in the practical information for a course or training program and in the webshop.
4.2. If the payment term is exceeded, the Client is in default. From the date the default occurs, the Client owes 3% per month on the outstanding amount, with any part of a month being considered a full month.
4.3. All extrajudicial collection costs of 15% of the outstanding amount (with a minimum of €75) are entirely at the expense of the Client. This includes, but is not limited to, the costs of lawyers, bailiffs, and collection agencies, which are determined in accordance with the applicable or customary rates.
4.4 The education provided by Equinestudies is registered with the CRKBO. As a result, the tuition fees are exempt from VAT.
4.5 Through the webshop, the Client can pay by credit card, PayPal, or iDeal. If the Client has a payment arrangement with Equinestudies or needs to pay in installments, the amount due must be paid via bank transfer.
5. Intellectual property
5.1. Equinestudies retains all copyright and other rights over the provided teaching materials. Without prior written permission from Equinestudies, none of this material may be reproduced or disclosed by means of print, photocopy, microfilm, slide, magnetic disk or tape, storage in a system accessible to third parties, or by any other electronic, mechanical, or other means. It is not permitted to make teaching materials available to third parties or to use them as teaching materials.
5.2. The Client may use all teaching materials created and/or provided by Equinestudies, or any other work, exclusively for personal use. All provided teaching materials are protected by copyright.
5.3 Equinestudies reserves the right to document all course days in words and images via social media. If you object to this, you can notify us at info@equinestudies.nl or inform the instructor of the relevant course weekend.
6. Execution of the assignment
6.1. If Equinestudies is unable to fulfill the assignment due to circumstances that were not known at the time the agreement was made, Equinestudies has the right to modify the agreement so that its execution becomes possible. This may include, for example, rescheduling to another date or location. Equinestudies strives to carry out the planned assignments at all times.
7. Liability
7.1. Participation in activities organized by Equinestudies is at your own risk.
7.2. The liability of Equinestudies, including statutory liability for third parties engaged by it, for financial and non-financial damages, including consequential damages, attributable to Equinestudies, is in all cases limited to a maximum of the invoice value of the part of the assignment from which the liability arises.
7.3. Equinestudies accepts no liability for damage to the personal property of the participant or Client.
7.4. All teaching materials and other works developed and/or compiled by Equinestudies, arising from or related to an assignment, have been prepared carefully and to the best of its knowledge. However, Equinestudies cannot guarantee their accuracy or completeness in any way. Equinestudies therefore accepts no liability for any damage of any kind resulting from actions and/or decisions based on these materials and works.
7.5. Equinestudies is not liable for damage or injury to persons and/or animals. The Client participates in the assignment at their own risk.
7.6. During practical days, the Contractor or third parties may provide horses for students. These horses must always be allowed to present themselves naturally. This means that any signals given by the horses must not be met with force. If you do not feel safe with a horse, inform someone in time and swap with another horse. As a participant, you are also responsible for contributing to your own safety and that of your fellow students. Always maintain communication if dangerous situations arise.
7.7. During the course days, work with horses takes place outdoors, which may result in clothing or belongings getting dirty. Equinestudies is not liable for soiled or damaged property and will not reimburse any such damage. Therefore, make sure in advance to wear appropriate clothing and sturdy shoes.
7.8. The participant is not insured through the training while practicing the Module or handling other people’s horses, except during the training days and on the premises where the training takes place. The student must arrange their own liability insurance.
8. Complaints and disputes
8.1. Any complaints about the services provided by Equinestudies must be submitted in writing and with reasons to Equinestudies no later than two weeks after delivery. If this is not done, the Client is deemed to have accepted the services provided.
8.2. Submitting a complaint does not release the Client from their payment obligations.
8.3 Complaints will be responded to within 4 weeks. See also the complaints procedure.
8.4. Dutch law applies to all assignments concluded with Equinestudies.
9. Platform usage rights
9.1 From the moment of user registration, Equinestudies grants the user a non-exclusive and non-transferable right to use the platform for personal, non-commercial purposes. Any other use requires prior written permission.
10. User obligations
10.1 The user is not permitted to make the platform available to a third party (including sharing login details), sell, rent, or modify the platform without prior written permission from Equinestudies. The user may also not remove or bypass technical measures intended to protect the platform (or have them removed or bypassed).
10.2. Users are not allowed to:
Reproduce, disclose, resell, use for commercial purposes, or otherwise make available to others any information obtained through the platform.
Infringe the rights of Equinestudies, including but not limited to intellectual property rights or privacy protection rights.
Use viruses or other software that may cause damage to the platform or that are intended to circumvent the platform’s technical protection measures and/or computer systems.
Damage the good name and/or interests of Equinestudies.
Create an account in the name of another person.
Share information in violation of copyright or post hyperlinks to such information.
10.3 If the user is under 18 years old, they must have permission from a parent or legal guardian to use the platform. By using the platform, the user guarantees that they are 18 years or older or have permission from a parent or legal guardian.
11.3 Intellectual property
11.1 The user acknowledges that the platform, its design, structure, concept, and software programs are the intellectual property of Equinestudies.
11.2 The user is not allowed to reproduce, modify, adapt, dismantle, decompile, distribute, rent, lend, or disclose any part of the platform through any public communication medium, unless they have obtained written permission from Equinestudies.
11.3 The user is not allowed to remove symbols indicating the intellectual, industrial, or other property rights of Equinestudies. The user may not circumvent or manipulate technical measures placed by Equinestudies or others in various software programs to protect its intellectual property rights.
12. Liability
12.1 Equinestudies does not guarantee that the platform and/or services will be accessible at all times and without interruptions or malfunctions. They are in no way liable or responsible to the user for any damage resulting from or caused by the (temporary) unavailability, (intermittent) failure, and/or improper functioning of the platform and/or services. They reserve the right to take the platform wholly or partially (temporarily) out of service for maintenance or modification work.
12.2 Equinestudies are not liable in the event of a data breach or other system malfunctions that cause the platform to be unavailable or compromise the integrity, confidentiality, or availability of information on the platform.
12.3 Despite the continuous care and attention given to the composition of the platform, Equinestudies cannot guarantee the completeness, accuracy, or up-to-date status of the content. Equinestudies accepts no liability for direct or indirect damage of any kind resulting from or in any way related to the use of the platform.
12.4 Equinestudies is not liable for the availability of (mobile) internet and/or the functioning of the equipment used by the user.
13. After purchase
13.1 The platform ‘The Horse Inside Out’ is valid for one year after purchase. After this period, the user can extend access to the platform for a fee determined by Equinestudies.
13.2 Access to the online courses Body Basics, Passive Physio & Breathwork is lifelong, as long as the course exists.
13.3 If the purchaser is not satisfied with the content of the online learning program, we regret this. The purchaser has a 14-day cooling-off period, after which it is no longer possible to receive a refund.
13.4 Equinestudies reserves the right at all times to adjust the offered functionality or content of the platform to improve or modify its functionality or content and to correct errors.
14. Termination of use
14.1 Equinestudies is entitled to block access to an account or permanently exclude a user from further use of the platform.
